Terms of Service

These terms are an agreement between you and ElevenX2 LLC, which runs NewsBlend. They cover any business that creates a NewsBlend account and anyone who uses newsblend.app. By creating an account or using the site, you agree to them and to our Privacy Policy.

What NewsBlend does

NewsBlend writes a newsletter from real local and topic news, summarized by AI in our own words with a link to the outlet that reported each story. A business adds its own note, stories and offers, reviews the issue, and NewsBlend sends it to that business's own contact list under the business's name. Each newsletter can also have its own web pages.

Your account

  • You must be at least 18 and allowed to act for the business the account represents.
  • Give us accurate information about your business, including a real mailing address for your emails, and keep your sign-in email secure.
  • You're responsible for what happens under your account and for the content you add: notes, stories, offers, images and business facts.

Your contact list and consent

Your contact list is yours. You decide who is on it, and you're responsible for having permission to email every person you add. We process the list on your behalf only to run NewsBlend for you. We never sell it, share it with another business, or add your readers to anyone else's newsletter.

By default, each person you upload gets a one-time confirmation email and receives nothing else until they confirm. On a paid plan you can skip that step. If you do, you're telling us those people already agreed to hear from your business, and you're responsible for that being true. Our email rules are part of these terms.

You're the sender of your newsletter, so you're responsible for following the email laws that apply to you, like CAN-SPAM. NewsBlend handles the mechanics for you: your mailing address in every email, a one-click unsubscribe, and honoring unsubscribes right away.

Acceptable use

You may not use NewsBlend to:

  • Upload purchased, rented, scraped or otherwise non-consented lists.
  • Send anything illegal, deceptive, hateful, harassing or sexually explicit, or anything that misrepresents who you are.
  • Infringe someone else's copyright, trademark, privacy or other rights.
  • Send malware or phishing, or try to get around our limits, security or sending safeguards.
  • Interfere with the service, other accounts, or other businesses' newsletters.

If bounce or complaint rates on your sends climb, we may slow, pause or review your sending to protect everyone's delivery. We can suspend or close an account that breaks these terms, with or without notice depending on how serious it is.

AI-written news and your content

News summaries are written by AI from public reporting by other outlets. We check them against their sources, but they can contain mistakes. They are general information, not professional advice, and every story links to the original so readers can go to the source. Look over each issue before you approve it; you can remove any story you don't want.

NewsBlend may also suggest wording for your note, tie-in lines or offers. Anything you approve goes out under your name, so make sure it's accurate.

Website scanning

If you ask NewsBlend to fill in your details from your website, you confirm it's your business's site and that we may read it for that purpose. Nothing from the scan is saved unless you keep it.

The Free-plan sponsor spot

The Free plan includes one clearly labeled sponsor spot per issue ("Sponsored · NewsBlend"), chosen by NewsBlend and placed after your business section. It is usually an affiliate offer: NewsBlend may earn a commission when a reader signs up, and the spot says so. It is never a direct competitor of your business, financial or lending offers never run in mortgage, lending, insurance or accounting businesses' issues, and sponsors never receive your readers' addresses. You can see which offer ran in each issue in the app. If no offer fits, the issue has no sponsor spot. Paid plans don't include a NewsBlend sponsor spot; upgrade to remove it.

Plans, fees and cancellation

Plans and prices are shown on newsblend.app. Current prices are early-access prices and may change; we'll tell you before any change affects your account. When paid plans start, payments will be taken through PayPal, plans renew until you cancel, and cancelling stops future charges. Fees already paid aren't refunded except where the law requires it.

Who owns what

You keep the rights to your contact list and to the content and business details you give us. You let us use them to run NewsBlend for you, including publishing your issues and their web pages. We keep the rights to the NewsBlend software, the news-writing system, and the design of the newsletters and pages it produces. News articles themselves belong to their publishers; we summarize and link, we don't republish them.

Services we rely on

NewsBlend runs on outside providers, including Supabase (data storage), Vercel (hosting), Amazon SES (email) and AI providers. A problem on their end can affect NewsBlend.

Disclaimers

NewsBlend is provided "as is" and "as available." We don't promise it will always be available or error-free, that every email will reach an inbox, or any particular open, click or sales result. Open counts in particular are approximate.

Limitation of liability

To the extent the law allows, ElevenX2 LLC isn't liable for indirect, incidental or consequential damages, like lost profits or lost data, and our total liability for any claim about NewsBlend is limited to the greater of what you paid us in the 12 months before the claim or $100.

Indemnity

If someone makes a claim against us because of your contact list, your content, or your breaking these terms or the law, you agree to cover our reasonable costs of dealing with it.

Ending your account

You can stop using NewsBlend and ask us to close your account at any time by emailing hello@newsblend.app. When an account closes, we stop sending for it and delete its data as described in the Privacy Policy, keeping only the records needed so unsubscribed, bounced or complaining addresses aren't emailed again.

Governing law

These terms are governed by California law, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Ventura County, California, and both of us agree to that location.

Changes to these terms

When we change these terms, we'll update the date at the top. If a change is significant, we'll email businesses with active accounts before it takes effect. Using NewsBlend after that means you accept the new terms.
